INTRODUCTION

These Terms and Conditions of Sale ("GTC") apply to any order placed by an individual acting as a consumer ("Customer") on the website www.unfa-ltd.co  ("Website") with Unfa Ltd, a company registered in the United Kingdom with company number 16379578

The purpose of these GTC is to govern the sale of products by the Seller to its Customers. In particular, they specify the conditions of ordering, payment, delivery, return, and refund of the products ordered by Customers.

The GTC are accessible at any time on the Website via a hyperlink located at the bottom of each page. Customers must read and accept the GTC before placing an order.

The applicable GTC are those in force on the day the order is placed.

Any order placed on the website implies the customer's unconditional acceptance of these gtc. The customer declares that they have read and accepted the gtc prior to payment.


ARTICLE 1 – DEFINITIONS

  • Customer : Refers to the contracting party of the Seller, acting as a consumer.
  • Order : Refers to the purchase of products by a Customer via the Website.
  • Terms and Conditions of Sale ("GTC"): Refers to these contractual conditions governing the sale of Products by the Seller.
  • Product Sheet : Refers to the page presenting the commercial offer related to the Products.
  • Delivery : Refers to the first presentation of the ordered Product to the delivery address provided by the Customer.
  • Parties : Refers collectively to the Seller and the Customer.
  • Products : Refers to all goods marketed by the Seller through the Website, compliant with European regulations and applicable standards in France.
  • Territory : Refers EU countries, and Switzerland.

ARTICLE 2 – PRODUCT CHARACTERISTICS

Before placing an order for any products on the Site or Application, and in accordance with the provisions of Article 6 of Directive 2011/83/EU on consumer rights, the User can review the essential characteristics of each product they wish to purchase. These details, including ingredients, usage instructions, and other relevant information, are provided on the respective product page.

The key characteristics of each product are detailed on the respective product page, including ingredients, usage instructions, and other relevant information. It is the responsibility of the User to carefully review these details before confirming their purchase.

The photographs and descriptions of the Products offered for sale on the Site and the Application are as precise as possible and only bind Unfa Ltd for what is precisely indicated. The User is however informed and accepts that certain characteristics of the Products and in particular their color may not correspond exactly to the photographs presented on the Site, due to technical constraints.

The safety and quality of the Products are guaranteed by compliance with the rules for transport and conservation of the Products until their delivery.

However, if the User notices that the safety or quality standards are not respected, he undertakes to inform Unfa Ltd immediately by sending an email to the address customerservice@unfa-limited.com, to allow Unfa Ltd to remedy this as quickly as possible.


ARTICLE 3 – PRODUCT PURCHASE ON THE WEBSITE

To purchase Products on the Website, Customers must be at least 18 years old and legally capable or duly authorized by their legal representatives if underage.

Customers must provide complete, accurate, and up-to-date information necessary for processing the Order. The Seller reserves the right to request additional documentation to verify the Customer's identity and details provided.

The Seller may cancel or refuse any Order in case of suspected fraudulent payment attempts.


ARTICLE 3 bis – SATISFACTION GUARANTEED

As part of our Satisfaction Guarantee, we want to ensure that you are fully satisfied with your purchase. If you are not satisfied for any reason, you can return the product, even if it has been opened.

3.1 Return Deadline and Conditions

You have 30 days from the receipt of your order to return the product for a refund or exchange. Products must be in their original packaging, in satisfactory condition, and accompanied by proof of purchase. Products that have been excessively used or altered will not be eligible for return.

3.2 Return Process

  • Notification : Inform us of your intention to return a product within 30 days by contacting customerservice@unfa-limited.com or using the return form on the Website.
  • Returning the Product : Return the product at your own expense to the address provided after your request, unless the product is defective or not as described.

Opened products are eligible for return provided if they are not excessively used or damaged.

3.3 Refund or Exchange

Upon receipt and verification of the product's condition:

  • Refund : A full refund of the product price, excluding shipping costs, will be issued using the original payment method.
  • Exchange : A replacement product will be sent, or a credit for future purchases will be offered.

3.4 Exclusions to the Satisfaction Guarantee

The Satisfaction Guarantee does not apply to:

  • Products excessively consumed;
  • Products damaged or altered preventing resale;
  • Products missing original packaging or accessories;
  • Products bought under promotions or special offers where exclusions are stated.

3.5 Right of Withdrawal and Satisfaction Guarantee

The Satisfaction Guarantee is provided in addition to the Customer's statutory right of withdrawal and offers extended conditions.

3.6 Request for Proof

We may request proof of the product's condition, including photos, proof of purchase, or additional relevant information, all handled confidentially.


ARTICLE 4 – ORDER

The Product Sheet presents the essential characteristics of the Products, which Customers must read carefully before placing an Order. In the event of unavailability, the Seller will promptly inform the Customer, offering a refund within 14 days if the Order is canceled.

The Customer selects the desired Products, quantity, and purchase modality (single purchase or Discovery Offer subscription) and is directed to the Order summary page.

The Customer is responsible for ensuring the accuracy of the Order information, especially billing and shipping details. Errors cannot be attributed to the Seller.

Finalization of the Order occurs after secure payment. A confirmation email will be sent automatically.

For the Discovery Offer, identical monthly Orders will be automatically placed unless canceled at least three (3) days before shipment.


ARTICLE 5 – PRICES

Prices are displayed in the currency selected by the user on the website, inclusive of all taxes (including VAT) where applicable.

Prices are firm and non-revisable during their period of validity.
The Seller may change prices at any time, but the applicable price is the one displayed at the time of the Order.

Currently, delivery fees are offered free of charge. However, the Seller reserves the right to modify this policy in the future; any applicable delivery fees will then be communicated clearly before the Order validation.
Customers may also be subject to import duties and taxes depending on the destination country, which will be at their own expense.


ARTICLE 6 – PAYMENT TERMS

Payment is made in full at the time of ordering or shipment (for subscriptions), via:

  • Credit Card;
  • PayPal.

Failure to complete payment results in cancellation of the Order.


ARTICLE 7 – DELIVERY

Products are delivered to the address provided by the Customer.

Estimated delivery time is generally within 7 days but may vary. The Seller cannot be held responsible for delays.

Shipping fees are indicated before final payment. The Customer can track the Order via their Account.

In case of error in the address leading to a return, reshipment fees will be borne by the Customer.


ARTICLE 8 – TRANSFER OF OWNERSHIP

Ownership of Products passes to the Customer only after full payment. However, risks transfer at the time of delivery.


ARTICLE 9 – RIGHT OF WITHDRAWAL

In accordance with European consumer protection law (Directive 2011/83/EU), customers normally have a period of 14 days from receipt of the goods to exercise their right of withdrawal without giving any reason.
However, pursuant to Article 16(c) of the Directive, the right of withdrawal does not apply to the supply of goods that are liable to deteriorate or expire rapidly, such as food products and dietary supplements.
Therefore, due to the perishable nature of our Products, customers do not have a right of withdrawal after delivery.
This exclusion does not affect customers' rights regarding defective or non-conforming Products, for which legal guarantees remain applicable.


ARTICLE 10 – LEGAL GUARANTEES

Customers benefit from:

  • A two-year legal guarantee of conformity;
  • A two-year legal guarantee against hidden defects from discovery.

The Seller will repair, replace, or refund defective products under these guarantees.


ARTICLE 11 – LIABILITY

The Seller's liability is limited to the obligations defined herein and excludes any case of force majeure or Customer error.


ARTICLE 12 – FORCE MAJEURE

Neither Party shall be liable for any failure or delay in the performance of its obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, or governmental actions ("Force Majeure Event").


ARTICLE 13 – PERSONAL DATA

Personal data is collected for order processing and customer service. For more information, Customers should refer to the Seller's Privacy Policy.

Customers can opt out of marketing communications at any time.

ARTICLE 15 – VALIDITY OF THE GTC

Should any clause be declared invalid, the remainder of the GTC shall remain in force.


ARTICLE 16 – MODIFICATION OF THE GTC

The Seller may update the GTC at any time. The applicable version is the one in effect at the time of the Order.


ARTICLE 17 – APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by the laws of England and Wales, without prejudice to the mandatory consumer protection rights applicable in the customer's country of residence.
In the event of a dispute, the Customer is invited to first contact the Seller in order to seek an amicable resolution.
If no amicable solution is reached, disputes shall be submitted to the exclusive jurisdiction of the competent courts of England and Wales.
